เมื่อความปรากฏแก่ศาลเองหรือความปรากฏตามคำแถลงของพนักงานอัยการ หรือเจ้าพนักงานว่าผู้กระทำความผิดไม่ปฏิบัติตามเงื่อนไขดังที่ศาลกำหนดตามมาตรา ๑๖๖ ศาลอาจตักเตือนผู้กระทำความผิด หรือกำหนดวิธีการตามมาตรา ๑๖๖ วรรคหนึ่ง เสียใหม่ หรือ พิจารณาลงโทษตามความเหมาะสมต่อไป
