ภายใต้บังคับมาตรา ๑๑๔ เมื่อมีการฟ้องคดีต่อศาลว่าบุคคลใดกระทำความผิด ตามลักษณะนี้ ถ้าไม่ปรากฏว่าผู้นั้นเป็นผู้ต้องหาหรืออยู่ในระหว่างถูกดำเนินคดีในความผิดอื่น ซึ่งเป็นความผิดที่มีโทษจำคุก หรืออยู่ในระหว่างรับโทษจำคุกตามคำพิพากษาของศาล ในกรณี ที่ศาลเห็นว่าพฤติการณ์แห่งคดียังไม่สมควรลงโทษจำเลย หากจำเลยสำนึกในการกระทำโดยตกลงเข้ารับ การบำบัดรักษา เมื่อศาลสอบถามพนักงานอัยการแล้ว หากศาลเห็นสมควร ให้ส่งตัวจำเลยไป สถานพยาบาลยาเสพติดเพื่อเข้ารับการบำบัดรักษาต่อไป
