ผู้ใดมีไว้ในครอบครองซึ่งยาเสพติดให้โทษในประเภท๑ประเภท ๒ หรือ ประเภท ๕ หรือวัตถุออกฤทธิ์ในประเภท ๑ หรือประเภท ๒ เพื่อเสพ อันเป็นการฝ่าฝืนมาตรา ๑๐๗ ต้องระวางโทษจำคุกไม่เกินสองปี หรือปรับไม่เกินสี่หมื่นบาท หรือทั้งจำทั้งปรับ
