ผู้ใดไม่ให้ถ้อยคำหรือไม่ส่งบัญชีเอกสารหรือวัตถุใด ๆ หรือไม่ยอมให้มีการตรวจ หรือทดสอบว่าผู้ใดมียาเสพติดอยู่ในร่างกายหรือไม่ ในการปฏิบัติหน้าที่ของเลขาธิการ ป.ป.ส. รองเลขาธิการ ป.ป.ส. หรือเจ้าพนักงาน ป.ป.ส. ในการสืบสวน สอบสวน หรือตรวจสอบทรัพย์สิน ตามกฎหมายว่าด้วยวิธีพิจารณาคดียาเสพติด ต้องระวางโทษจำคุกไม่เกินหนึ่งปี หรือปรับไม่เกิน สองหมื่นบาท หรือทั้งจำทั้งปรับ
