ใบอนุญาตตามมาตรา ๓๔ และมาตรา ๓๕ และใบอนุญาตเฉพาะคราว เพื่อการนำเข้าหรือส่งออกตามมาตรา ๓๖ ให้คุ้มกันถึงลูกจ้างหรือตัวแทนของผู้รับอนุญาตซึ่งได้ กระทำไปตามหน้าที่ที่ได้รับมอบหมายจากผู้รับอนุญาต ให้สันนิษฐานไว้ก่อนว่าการกระทำของลูกจ้างหรือตัวแทนของผู้รับอนุญาตที่ได้กระทำไป ตามหน้าที่ที่ได้รับมอบหมายเป็นการกระทำของผู้รับอนุญาตด้วย
