ให้ผู้รับอนุญาตผลิต นำเข้า ส่งออก จำหน่าย หรือมีไว้ในครอบครองซึ่งยาเสพติด ให้โทษในประเภท ๒ ประเภท ๓ หรือประเภท ๕ หรือผู้รับอนุญาตผลิต นำเข้า ส่งออก หรือ จำหน่ายซึ่งวัตถุออกฤทธิ์ในประเภท ๒ ประเภท ๓ หรือประเภท ๔ ต้องจัดให้มีเภสัชกรอยู่ประจำ ควบคุมกิจการตลอดเวลาทำการซึ่งระบุไว้ในใบอนุญาต พร้อมทั้งต้องดูแลให้เภสัชกรได้ปฏิบัติหน้าที่ ทั้งนี้ ตามที่รัฐมนตรีว่าการกระทรวงสาธารณสุขกำหนดในกฎกระทรวง
