กรรมการผู้ทรงคุณวุฒิ ต้องมีคุณสมบัติและไม่มีลักษณะต้องห้ามดังต่อไปนี้
(๑) มีสัญชาติไทย
(๒) ไม่เป็นบุคคลล้มละลาย
(๓) ไม่เคยได้รับโทษจำคุกโดยคำพิพากษาถึงที่สุดให้จำคุก เว้นแต่เป็นโทษสำหรับความผิด ที่ได้กระทำโดยประมาทหรือความผิดลหุโทษ
(๔) ไม่เคยเป็นผู้ถูกสั่งให้ออกตามมาตรา ๗
(๕) ไม่เป็นข้าราชการการเมือง ผู้ดำรงตำแหน่งในทางการเมือง สมาชิกสภาท้องถิ่น หรือผู้บริหารท้องถิ่นหรือกรรมการที่ปรึกษา หรือเจ้าหน้าที่ของพรรคการเมือง เล่ม ๑๒๕ ตอนที่ ๒๘ ก
