ให้ประธานกรรมการและกรรมการอำนวยการโรงงานยาสูบ กระทรวงการคลัง ตามระเบียบการบริหารงานโรงงานยาสูบ พ.ศ. ๒๕๔๓ ซึ่งแก้ไขเพิ่มเติมโดยระเบียบการบริหารงาน โรงงานยาสูบ (ฉบับที่ ๓) พ.ศ. ๒๕๕๗ ซึ่งดำรงตำแหน่งอยู่ในวันก่อนวันที่พระราชบัญญัตินี้ใช้บังคับ เป็นประธานกรรมการและกรรมการการยาสูบแห่งประเทศไทยตามพระราชบัญญัตินี้ และปฏิบัติหน้าที่ ต่อไปจนกว่าจะมีคณะกรรมการการยาสูบแห่งประเทศไทยตามพระราชบัญญัตินี้ ซึ่งต้องไม่เกินเก้าสิบวัน นับแต่วันที่พระราชบัญญัตินี้ใช้บังคับ
