Section ๔๙

นอกจากการพ้นจากตำแหน่งตามวาระตามมาตรา ๔๗ อำนวยการพ้นจาก ตำแหน่งเมื่อ

(๑) ตาย

(๒) ลาออก

(๓) คณะกรรมการกำกับสำนักงานส่งเสริมเศรษฐกิจดิจิทัลให้ออก เพราะไม่ผ่านการประเมิน หรือมีผลการประเมินอยู่ในขั้นต่ำกว่าดีสองปีติดต่อกัน หรือเมื่อคณะกรรมการกำกับสำนักงานส่งเสริม เศรษฐกิจดิจิทัล เห็นว่าหากให้อยู่ในตำแหน่งต่อไปจะก่อให้เกิดความเสียหายแก่สำนักงานส่งเสริมเศรษฐกิจดิจิทัล อย่างร้ายแรง เล่ม ๑๓๔ ตอนที่ ๑๐ ก

(๔) ได้รับโทษจำคุกโดยคำพิพากษาถึงที่สุดให้จำคุก

(๕) ขาดคุณสมบัติหรือมีลักษณะต้องห้ามตามมาตรา ๔๖
