ผู้ยื่นคำขอรับใบอนุญาตประกอบกิจการในเขตปลอดอากรต้องมีคุณสมบัติและ ไม่มีลักษณะต้องห้าม ดังต่อไปนี้
(๑) เป็นนิติบุคคล
(๒) ได้รับความยินยอมให้ประกอบกิจการจากผู้ได้รับใบอนุญาตจัดตั้งเขตปลอดอากร
(๓) ไม่เป็นผู้อยู่ในระหว่างถูกสั่งพักใช้ใบอนุญาตประกอบกิจการในเขตปลอดอากร
(๔) ไม่เคยถูกเพิกถอนใบอนุญาตประกอบกิจการในเขตปลอดอากร เว้นแต่ได้ถูกเพิกถอน ใบอนุญาตมาแล้วเกินสามปีก่อนวันยื่นคำขอรับใบอนุญาต
(๕) มีคุณสมบัติหรือไม่มีลักษณะต้องห้ามอื่นตามที่กำหนดในกฎกระทรวง
