ผู้อยู่ในอากาศยานในระหว่างการบินผู้ใดยึดหรือเข้าควบคุมอากาศยานโดยใช้กำลัง ประทุษร้ายหรือขู่เข็ญว่าจะใช้กำลังประทุษร้ายผู้อื่น หรือขู่ว่าจะกระทำอันตรายต่ออากาศยานนั้น ต้องระวางโทษประหารชีวิต จำคุกตลอดชีวิต หรือจำคุกตั้งแต่สิบปีถึงยี่สิบปี
