ในกรณีที่ผู้เสียหาย ผู้ต้องหา สามี ภริยา ผู้บุพการี ผู้สืบสันดานหรือญาติสนิท ของบุคคลดังกล่าวร้องเรียนว่า ไม่ได้รับความเป็นธรรมจากการสอบสวนคดีอาญา เลขาธิการอาจให้ พนักงานสอบสวนหรือหัวหน้าพนักงานสอบสวนผู้รับผิดชอบมาชี้แจง หากเห็นว่าผู้ต้องหาหรือ ผู้เสียหายไม่ได้รับความเป็นธรรมจากการสอบสวนคดีอาญาจริง ให้เลขาธิการแจ้งหัวหน้าของพนักงาน สอบสวนนั้นพิจารณาดำเนินการให้เกิดความเป็นธรรมต่อไป
