ในกรณีที่องค์กรปกครองส่วนท้องถิ่นวางและจัดทำผังเมืองเฉพาะตามมาตรา ๔๑ ให้ส่งผังเมืองเฉพาะไปยังกรมโยธาธิการและผังเมืองพิจารณาให้ความเห็น ถ้ากรมโยธาธิการและผังเมือง ไม่เห็นพ้องด้วยกับผังเมืองเฉพาะ และองค์กรปกครองส่วนท้องถิ่นไม่อาจแก้ไขปรับปรุงผังเมืองเฉพาะ ให้สอดคล้องกับความเห็นของกรมโยธาธิการและผังเมืองได้ ให้กรมโยธาธิการและผังเมืองเสนอ คณะกรรมการผังเมืองเพื่อพิจารณาชี้ขาด
