ในท้องที่ที่ใช้บังคับพระราชบัญญัติหรือพระราชกฤษฎีกาให้ใช้บังคับผังเมืองเฉพาะ ห้ามบุคคลใดใช้ประโยชน์ที่ดินหรือแก้ไขหรือเปลี่ยนแปลงอสังหาริมทรัพย์ให้ผิดไปจากที่ได้กำหนดไว้ ในพระราชบัญญัติหรือพระราชกฤษฎีกาให้ใช้บังคับผังเมืองเฉพาะหรือกฎกระทรวงที่ออกตามมาตรา ๔๐
