เมื่อคณะกรรมการผังเมืองเห็นชอบกับผังเมืองเฉพาะที่องค์กรปกครองส่วนท้องถิ่น หรือกรมโยธาธิการและผังเมืองวางและจัดทำแล้ว ให้กรมโยธาธิการและผังเมืองเสนอผังเมืองเฉพาะต่อ รัฐมนตรี เพื่อดำเนินการตราพระราชบัญญัติให้ใช้บังคับผังเมืองเฉพาะนั้นต่อไป ในกรณีที่ผังเมืองเฉพาะไม่มีองค์ประกอบตามมาตรา ๔๐ (๕) (ก) (ง) และ (ญ) (๖) และ
(๗) ให้กรมโยธาธิการและผังเมืองเสนอผังเมืองเฉพาะต่อคณะรัฐมนตรี เพื่อดำเนินการออกเป็นพระราชกฤษฎีกา ให้ใช้บังคับผังเมืองเฉพาะ
