มรดกภูมิปัญญาทางวัฒนธรรมที่ได้รับการส่งเสริมและรักษาตามพระราชบัญญัตินี้ ต้องมีลักษณะอย่างหนึ่งอย่างใด ดังต่อไปนี้
(๑) วรรณกรรมพื้นบ้านและภาษา
(๒) ศิลปะการแสดง
(๓) แนวปฏิบัติทางสังคม พิธีกรรม ประเพณี และเทศกาล
(๔) ความรู้และการปฏิบัติเกี่ยวกับธรรมชาติและจักรวาล
(๕) งานช่างฝีมือดั้งเดิม
(๖) การเล่นพื้นบ้าน กีฬาพื้นบ้าน และศิลปะการต่อสู้ป้องกันตัว
(๗) ลักษณะอื่นตามที่กำหนดในกฎกระทรวง มรดกภูมิปัญญาทางวัฒนธรรมจะเข้าลักษณะใดตามวรรคหนึ่ง ให้เป็นไปตามที่คณะกรรมการ ประกาศกำหนด
