ผู้ใดต่อสู้ หรือขัดขวางเจ้าพนักงานหรือผู้ซึ่งต้องช่วยเจ้าพนักงาน ตามกฎหมายในการปฏิบัติการตามหน้าที่ ต้องระวางโทษจำคุกไม่เกินหนึ่งปี หรือปรับไม่เกินสองพัน บาทหรือทั้งจำทั้งปรับ ถ้าการต่อสู้หรือขัดขวางนั้น ได้กระทำโดยใช้กำลังประทุษร้ายหรือขู่เข็ญว่าจะใช้กำลัง ประทุษร้ายผู้กระทำต้องระวางโทษจำคุกไม่เกินสองปี หรือปรับไม่เกินสี่พันบาท หรือทั้งจำทั้งปรับ
