ผู้ใดให้ ขอให้หรือรับว่าจะให้ทรัพย์สิน หรือประโยชน์อื่นใดแก่เจ้า พนักงาน สมาชิกสภานิติบัญญัติแห่งรัฐ สมาชิกสภาจังหวัดหรือสมาชิกสภาเทศบาล เพื่อจูงใจให้ กระทำการไม่กระทำการ หรือประวิงการกระทำอันมิชอบด้วยหน้าที่ ต้องระวางโทษจำคุกไม่เกินห้าปี หรือปรับไม่เกินหนึ่งหมื่นบาทหรือทั้งจำทั้งปรับ
