ผู้ใดเป็นเจ้าพนักงาน ใช้อำนาจในตำแหน่งโดยมิชอบ ข่มขืนใจหรือ จูงใจเพื่อให้บุคคลใดมอบให้หรือหามาให้ซึ่งทรัพย์สินหรือประโยชน์อื่นใดแก่ตนเองหรือผู้อื่น ต้อง ระวางโทษจำคุกตั้งแต่ห้าปีถึงยี่สิบปี หรือจำคุกตลอดชีวิต และปรับตั้งแต่สองพันบาทถึงสี่หมื่นบาท หรือประหารชีวิต
