ผู้ใดเป็นเจ้ พนักงาน สมาชิกสภานิติบัญญัติแห่งรัฐ สมาชิกสภา จังหวัด หรือสมาชิกสภาเทศบาล เรียก รับ หรือยอมจะรับทรัพย์สิน หรือประโยชน์อื่นใดสำหรับ ตนเองหรือผู้อื่นโดยมิชอบ เพื่อกระทำการหรือไม่กระทำการอย่างใดในตำแหน่งไม่ว่าการนั้นจะชอบ หรือมิชอบด้วยหน้าที่ ต้องระวางโทษจำคุกตั้งแต่ห้าปีถึงยี่สิบปี หรือจำคุกตลอดชีวิต และปรับตั้งแต่ สองพันบาทถึงสี่หมื่นบาทหรือประหารชีวิต
