ผู้ใดเป็นเจ้าพนักงาน รู้หรืออาจรู้ความลับในราชการ กระทำโดย ประการใดๆอันมิชอบด้วยหน้าที่ ให้ผู้อื่นล่วงรู้ความลับนั้น ต้องระวางโทษจำคุกไม่เกินห้าปี หรือ ปรับไม่เกินหนึ่งหมื่นบาท หรือทั้งจำทั้งปรับ
