ถ้าการแจ้งข้อความตามมาตรา ๑๗๒หรือมาตรา ๑๗๓เป็นการเพื่อ จะแกล้งให้บุคคลใดต้องถูกบังคับตามวิธีการเพื่อความปลอดภัย ผู้กระทำต้องระวางโทษจำคุกไม่เกิน สามปี และปรับไม่เกินหกพันบาท ถ้าการแจ้งตามความในวรรคแรก เป็นการเพื่อจะแกล้งให้บุคคลใดต้องรับโทษหรือ รับโทษหนักขึ้น ผู้ ระทำต้องระวางโทษจำคุกไม่เกินห้าปี และปรับไม่เกินหนึ่งหมื่นบาท
