ผู้ใดกระทำความผิดตามมาตรา ๑๗๕แล้วลุแก่โทษต่อศาล และขอ ถอนฟ้องหรือแก้ฟ้องก่อนมีคำพิพากษา ให้ศาลลงโทษน้อยกว่าที่กฎหมายกำหนดไว้หรือศาลจะไม่ ลงโทษเลยก็ได้
