ผู้ใดเอาความอันเป็นเท็จฟ้องผู้อื่นต่อศาลว่ากระทำความผิดอาญา หรือว่ากระทำความผิดอาญาแรงกว่าที่เป็นความจริง ต้องระวางโทษจำคุกไม่เกินห้าปี และปรับไม่เกิน หนึ่งหมื่นบาท
