ในเขตท้องที่ใดที่คณะกรรมการ จัดที่ดินแปลงเล็ก ยังมิได้ประกาศเขตสำรวจที่ดินตามความในหมวดนี้ก็ดี แปลงน้อย ๓๒ หรือในกรณีที่สภาพของที่ดินเป็นแปลงเล็กแปลงน้อยก็ดี ราษฎรจะขออนุญาตจับจองที่ดินได้โดยปฏิบัติตาม ระเบียบข้อบังคับข้อกำหนดและเงื่อนไขที่คณะกรรมการ กำหนด และเมื่อพนักงานเจ้าหน้าที่อนุญาตแล้วก็ให้ ออกใบจองให้ต่อไป
