กำรพิจำรณำเหตุและวัตถุประสงค์แห่งกำรเวนคืนตำมข้อ ๒
(๕) นอกจำก วัตถุประสงค์ตำมที่พระรำชกฤษฎีกำตามมาตรา ๘ กำหนดไว้แล้ว ให้พิจำรณำถึงเหตุที่ทำให้ต้องเวนคืน ประกอบด้วย ในกรณีที่เหตุและวัตถุประสงค์เป็นไปเพื่อประโยชน์สำธำรณะแต่ผู้ถูกเวนคืนจะไม่ได้รับ ประโยชน์นั้นโดยตรงด้วย หรือเป็นกรณีที่กำรดำเนินกำรตำมวัตถุประสงค์นั้นมีกำรเรียกเก็บค่ำบริกำร จำกผู้ใช้ประโยชน์ ให้พิจำรณำเพิ่มรำคำเบื้องต้นสำหรับที่ดินที่เวนคืนให้ตำมควรแก่กรณี
