กรรมการข้าราชการตำรวจผู้ทรงคุณวุฒิมีวาระการดำรงตำแหน่งสี่ปี และ ให้ดำรงตำแหน่งได้เพียงวาระเดียว ให้กรรมการข้าราชการตำรวจผู้ทรงคุณวุฒิซึ่งพ้นจากตำแหน่งตามวาระปฏิบัติหน้าที่ต่อไป จนกว่ากรรมการข้าราชการตำรวจผู้ทรงคุณวุฒิซึ่งได้รับเลือกใหม่เข้ารับหน้าที่
