ในการคัดเลือกเอกชนจะต้องใช้วิธีประมูล เว้นแต่เป็นกรณีที่คณะรัฐมนตรี ได้อนุมัติให้ใช้วิธีการคัดเลือกเอกชนโดยไม่ใช้วิธีประมูลตามมาตรา ๒๕และมาตรา ๓๔ เท่านั้น หลักเกณฑ์ วิธีการ และเงื่อนไขในการคัดเลือกเอกชนตามวรรคหนึ่งให้เป็นไปตามที่คณะกรรมการ ประกาศกำหนด
