การประกาศเชิญชวนครั้งใด ถ้ามีเอกชนยื่นข้อเสนอเพียงรายเดียวหรือมีเอกชน ยื่นข้อเสนอหลายรายแต่ยื่นข้อเสนอถูกต้องตามรายการในเอกสารสำหรับการคัดเลือกเอกชนเพียงรายเดียว หากคณะกรรมการคัดเลือกเห็นว่ารัฐจะได้ประโยชน์ก็ให้ดำเนินการตามขั้นตอนที่กำหนดในพระราชบัญญัตินี้ ต่อไป
