เมื่อคณะกรรมการคัดเลือกให้ความเห็นชอบร่างประกาศเชิญชวน ร่างเอกสาร สำหรับการคัดเลือกเอกชน และร่างสัญญาร่วมลงทุน แล้ว ให้หน่วยงานเจ้าของโครงการและ คณะกรรมการคัดเลือก ดำเนินการคัดเลือกเอกชนตามหลักเกณฑ์ วิธีการ และเงื่อนไขที่คณะกรรมการ กำหนดในมาตรา ๓๒
