ในการใช้อำนาจหน้าที่ของผู้ควบคุมอากาศยาน เจ้าหน้าที่ประจำอากาศยาน ผู้โดยสาร ผู้ดำเนินการเดินอากาศหรือผู้ทำการแทนบุคคลดังกล่าวตามบทบัญญัติในหมวดนี้ ย่อมไม่ก่อให้เกิด ความรับผิดทางอาญาและทางแพ่งต่อผู้ใด เว้นแต่กระทำการโดยไม่สุจริตหรือเกินสมควรแก่เหตุ
