ในการปฏิบัติหน้าที่ตามพระราชบัญญัตินี้ ให้เจ้าหน้าที่ที่เกี่ยวกับความผิด ในอากาศยานและเจ้าหน้าที่ผู้รักษาความปลอดภัยในอากาศยานเป็นเจ้าพนักงานตามประมวลกฎหมายอาญา และเป็นพนักงานฝ่ายปกครองหรือตำรวจชั้นผู้ใหญ่ตามประมวลกฎหมายวิธีพิจารณาความอาญา
