เจ้าพนักงานเรือนจำจะใช้กำลังบังคับแก่ผู้ต้องขังไม่ได้ เว้นแต่กรณีดังต่อไปนี้
(๑) การกระทำเพื่อป้องกันตัว
(๒) ผู้ต้องขังพยายามหลบหนี ใช้กำลังกายขัดขืนโดยทางตรงหรือทางอ้อมหรือไม่ปฏิบัติตามคำสั่ง ที่ชอบด้วยกฎหมายของเจ้าพนักงานเรือนจำหรือระเบียบกรมราชทัณฑ์ การดำเนินการตามวรรคหนึ่ง เจ้าพนักงานเรือนจำจะใช้กำลังบังคับได้เพียงเท่าที่จำเป็นและเหมาะสม กับพฤติการณ์ และต้องรายงานเหตุต่อผู้บัญชาการเรือนจำทันที
