เจ้าพนักงานเรือนจำ ข้าราชการหรือบุคลากรจากส่วนราชการอื่น ตามมาตรา ๑๗ วรรคสอง และบุคคลซึ่งช่วยเหลือเจ้าพนักงานเรือนจำตามมาตรา ๒๘ ไม่ต้องรับผิดทางแพ่ง ทางอาญา หรือทางวินัย เนื่องจากการปฏิบัติหน้าที่ตามพระราชบัญญัตินี้ หากเป็นการกระทำที่สุจริตไม่เลือกปฏิบัติ และไม่เกินสมควรแก่เหตุหรือไม่เกินกว่ากรณีจำเป็น แต่ไม่ตัดสิทธิผู้ได้รับความเสียหายที่จะเรียกร้อง ค่าเสียหายจากทางราชการตามกฎหมายว่าด้วยความรับผิดทางละเมิดของเจ้าหน้าที่ เล่ม ๑๓๔ ตอนที่ ๒๑ ก
