ภายใต้บังคับมาตรา ๖๖ห้ามมิให้หน่วยงานของรัฐเปิดเผยข้อเสนอของผู้ยื่นข้อเสนอ ในส่วนที่เป็นสาระสำคัญและเป็นข้อมูลทางเทคนิคของผู้ยื่นข้อเสนอ ซึ่งอาจก่อให้เกิดการได้เปรียบเสียเปรียบ ระหว่างผู้ยื่นข้อเสนอด้วยกันต่อผู้ซึ่งมิได้เกี่ยวข้องกับการจัดซื้อจัดจ้างครั้งนั้นหรือต่อผู้ยื่นข้อเสนอรายอื่น เว้นแต่เป็นการเปิดเผยข้อมูลต่อผู้มีอำนาจหน้าที่ตามกฎหมาย หรือการดำเนินการตามกฎหมาย
