ในการจัดซื้อจัดจ้าง ผู้ที่มีหน้าที่ดำเนินการต้องไม่เป็นผู้มีส่วนได้เสียกับ ผู้ยื่นข้อเสนอหรือคู่สัญญาในงานนั้น เล่ม ๑๓๔ ตอนที่ ๒๔ ก ในกรณีที่ปรากฏในภายหลังว่าผู้ที่มีหน้าที่ดำเนินการตามวรรคหนึ่งเป็นผู้มีส่วนได้เสียกับ ผู้ยื่นข้อเสนอหรือคู่สัญญาในขั้นตอนหนึ่งขั้นตอนใดของการจัดซื้อจัดจ้าง หรือเป็นกรรมการในคณะกรรมการ การจัดซื้อจัดจ้าง แต่ไม่มีผลต่อการจัดซื้อจัดจ้างอย่างมีนัยสำคัญ การจัดซื้อจัดจ้างนั้นย่อมไม่เสียไป
