การกำหนดคุณลักษณะเฉพาะของพัสดุที่จะทำการจัดซื้อจัดจ้าง ให้หน่วยงานของรัฐ คำนึงถึงคุณภาพ เทคนิค และวัตถุประสงค์ของการจัดซื้อจัดจ้างพัสดุนั้น และห้ามมิให้กำหนดคุณลักษณะเฉพาะ ของพัสดุให้ใกล้เคียงกับยี่ห้อใดยี่ห้อหนึ่ง หรือของผู้ขายรายใดรายหนึ่งโดยเฉพาะ เว้นแต่พัสดุที่จะทำ การจัดซื้อจัดจ้างตามวัตถุประสงค์นั้นมียี่ห้อเดียวหรือจะต้องใช้อะไหล่ของยี่ห้อใด ก็ให้ระบุยี่ห้อนั้นได้
