ผู้ใดกระทำให้เกิดเพลิงไหม้แก่วัตถุใด ๆแม้เป็นของตนเอง จนน่าจะ เป็นอันตรายแก่บุคคลอื่ หรือทรัพย์ของผู้อื่น ต้องระวางโทษจำคุกไม่เกินเจ็ดปี และปรับไม่เกินหนึ่ง หมื่นสี่พันบาท ถ้าการกระทำความผิดดักล่าวในวรรคแรกเป็นเหตุให้เกิดเพลิงไหม้แก่ทรัพย์ตามที่ ระบุไว้ในมาตรา ๒๑๘ผู้กระทำต้องระวางโทษดังที่บัญญัติไว้ในมาตรา ๒๑๘
