ผู้ใดเอาของที่มีพิษหรือสิ่งอื่นที่น่าจะเป็นอันตรายแก่สุขภาพเจือลงใน อาหาร หรือในน้ำซึ่งอยู่ในบ่อ สระหรือที่ขงน้ำใด ๆและอาหารหรือน้ำนั้นได้ อยู่หรือจัดไว้เพื่อ ประชาชนบริโภคต้องระวางโทษจำคุกตั้งแต่หกเดือนถึงสิบปี และปรับตั้งแต่หนึ่งพันบาทถึงสองหมื่น บาท
