ผู้ใดได้มาซึ่งสิ่งใด ๆโดยไม่รู้ว่าเป็นของปลอมตามมาตรา ๒๔๐หรือ ของแปลงตามมาตรา ๒๔๑ถ้าต่อมารู้ว่าเป็นของปลอมหรือของแปลงเช่นว่านั้น ยังขืนนำออกใช้ ต้อง ระวางโทษจำคุกไม่เกินสิบปี หรือปรับไม่เกินสองหมื่นบาทหรือทั้งจำทั้งปรับ
