ผู้ใดรู้หรืออาจรู้ความลับในทางราชการเกี่ยวกับการดำเนินการตามประมวล กฎหมายนี้ กระทำด้วยประการใดๆให้ผู้อื่นรู้หรืออาจรู้ความลับดังกล่าว เว้นแต่เป็นการปฏิบัติการ ตามหน้าที่หรือตามกฎหมาย ต้องระวางโทษจำคุกไม่เกินห้าปี หรือปรับไม่เกินหนึ่งแสนบาท หรือ ทั้งจำทั้งปรับ
