บรรดายาเสพติดให้โทษในประเภท ๑ ประเภท ๒ ประเภท ๔ หรือประเภท ๕ วัตถุออกฤทธิ์ เครื่องมือ เครื่องใช้ ยานพาหนะ เครื่องจักรกล หรือทรัพย์สินอื่นใดที่ใช้ในการกระทำ ความผิดเกี่ยวกับยาเสพติด หรือใช้เป็นอุปกรณ์ให้ได้รับผลในการกระทำความผิดเกี่ยวกับยาเสพติด หรือมีไว้เพื่อใช้ในการกระทำความผิดเกี่ยวกับยาเสพติดอันเป็นความผิดตามประมวลกฎหมายยาเสพติด ให้ริบเสียทั้งสิ้น ไม่ว่าจะมีผู้ถูกลงโทษตามคำพิพากษาหรือไม่ก็ตาม
