ในกรณีที่ผู้กระทำผิดภาคนี้เป็นนิติบุคคล ต้องระวางโทษปรับสองเท่าของโทษ ที่บัญญัติไว้สำหรับความผิดนั้น ถ้าการกระทำผิดของนิติบุคคลตามวรรคหนึ่ง เกิดจากการสั่งการหรือการกระทำของกรรมการ หรือผู้จัดการ หรือบุคคลใดซึ่งรับผิดชอบในการดำเนินงานของนิติบุคคลนั้น หรือในกรณีที่บุคคลดังกล่าว มีหน้าที่ต้องสั่งการหรือกระทำการและละเว้นไม่สั่งการหรือไม่กระทำการจนเป็นเหตุให้นิติบุคคลนั้น กระทำความผิด ผู้นั้นต้องระวางโทษตามที่บัญญัติไว้สำหรับความผิดนั้น เลม่ ๑๓๘ ตอนที่ ๗๓ ก หนา้ ๖๕
