ให้มีคณะกรรมการวินิจฉัยอากรศุลกากร ประกอบด้วย ปลัดกระทรวงการคลัง เป็นประธานกรรมการ เลขาธิการคณะกรรมการกฤษฎีกา อธิบดีกรมศุลกากร อธิบดีกรมสรรพากร อธิบดีกรมสรรพสามิต ผู้อำนวยการสำนักงานเศรษฐกิจการคลัง และผู้ทรงคุณวุฒิซึ่งรัฐมนตรีแต่งตั้ง จำนวนไม่เกินสามคน เป็นกรรมการ ให้อธิบดีแต่งตั้งข้าราชการในกรมศุลกากรคนหนึ่งเป็นเลขานุการและอีกไม่เกินสองคน เป็นผู้ช่วยเลขานุการ
