คณะกรรมการวินิจฉัยอากรศุลกากรมีอำนาจหน้าที่ ดังต่อไปนี้
(๑) กำหนดขอบเขตการใช้อำนาจของพนักงานศุลกากร
(๒) กำหนดหลักเกณฑ์ วิธีการ และระยะเวลาในการตรวจสอบและประเมินอากร
(๓) วินิจฉัยปัญหาเกี่ยวกับอากรที่กรมศุลกากรขอความเห็น
(๔) ให้คำปรึกษาหรือเสนอแนะแก่รัฐมนตรีในการจัดเก็บอากร การกำหนดตาม
(๑) และ(๒) เมื่อได้รับความเห็นชอบจากรัฐมนตรีและประกาศในราชกิจจานุเบกษาแล้ว ให้พนักงานศุลกากรปฏิบัติตาม คำวินิจฉัยของคณะกรรมการวินิจฉัยอากรศุลกากรตาม
(๓) ให้เป็นที่สุด
