นอกจากการพ้นจากตำแหน่งตามวาระตามมาตรา ๓๓ กรรมการผู้ทรงคุณวุฒิ ตามมาตรา ๓๒ พ้นจากตำแหน่งเมื่อ
(๑) ตาย
(๒) ลาออก
(๓) รัฐมนตรีให้ออกเพราะบกพร่องต่อหน้าที่ มีความประพฤติเสื่อมเสีย หรือ หย่อนความสามารถ
(๔) เป็นบุคคลล้มละลาย คนไร้ความสามารถ หรือคนเสมือนไร้ความสามารถ
(๕) ได้รับโทษจำคุกโดยคำพิพากษาถึงที่สุดให้จำคุก เว้นแต่เป็นโทษสำหรับความผิดที่ได้ กระทำโดยประมาทหรือความผิดลหุโทษ
