ในกรณีที่ไม่มีผู้ดำรงตำแหน่งเลขาธิการหรือมีแต่ไม่อาจปฏิบัติหน้าที่ได้ ให้คณะกรรมการแต่งตั้งรองเลขาธิการคนหนึ่งเป็นผู้รักษาการแทนเลขาธิการ ในกรณีที่ไม่มีรองเลขาธิการ หรือมีแต่ไม่อาจปฏิบัติหน้าที่ได้ ให้คณะกรรมการแต่งตั้งพนักงานของสำนักงานคนหนึ่งเป็นผู้รักษาการ แทนเลขาธิการ ให้ผู้รักษาการแทนเลขาธิการตามวรรคหนึ่งมีอำนาจหน้าที่เช่นเดียวกับเลขาธิการ
