ห้ามมิให้ผู้ซึ่งพ้นจากตำแหน่งเลขาธิการดำรงตำแหน่งใด ๆ ในบริษัทจำกัด บริษัทมหาชนจำกัด หรือธุรกิจอื่นใดซึ่งเป็นคู่กรณีที่อยู่ในกระบวนพิจารณาของคณะกรรมการ เว้นแต่ จะได้พ้นจากตำแหน่งมาแล้วไม่น้อยกว่าสองปี
