ในการจ้างผู้ให้บริการงานจ้างออกแบบหรือควบคุมงานก่อสร้าง ผู้ให้บริการ ต้องมีใบอนุญาตประกอบวิชาชีพสถาปัตยกรรมหรือวิศวกรรม แล้วแต่กรณี ผู้ให้บริการตามวรรคหนึ่งที่เป็นนิติบุคคล ต้องเป็นผู้ที่ได้ขึ้นทะเบียนไว้กับสภาวิชาชีพนั้น ๆ ด้วย
