เมื่อปรากฏว่าผู้ใดได้มาซึ่งที่ดิน กรณีถือแทน แห่งใดในฐานะเป็นเจ้าของแทนคนต่างด้าวหรือนิติ ต่างด้าว บุคคลตามความในมาตรา ๙๗หรือมาตรา ๙๘ให้ อธิบดีมีอำนาจทำการจำหน่ายที่ดินนั้นและให้นำ บทบัญญัติมาตรา ๙๔มาใช้บังคับโดยอนุโลม
